Digital Millennium Copyright Act Policy

According to the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright holder or their authorized representative can send us a notice to take down infringing content via our DMCA Agent, as listed below. As an internet service provider, we are eligible for immunity from infringement claims under the “safe harbor” provisions of the DMCA. To file a legitimate infringement claim, you are required to provide us with the following information:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner (or someone authorized to act on their behalf)
  2. Identification of the copyrighted work that has been infringed
  3. Identification of the infringing material to be removed, along with details to help us locate it.
  4. Contact information of the complaining party, including name, physical address, email address, phone number, and fax number
  5. A statement indicating the belief of unauthorized use of the material by the copyright agent
  6. A statement verifying the accuracy of the notification and the authority of the complaining party to act on behalf of the copyright owner

Section 17 USC §512(f) imposes civil damage penalties on individuals who knowingly provide false information in a copyright infringement notification under 17 USC §512(c)(3).

Please be aware that we might share the identity and information of any copyright infringement claim we receive with the alleged infringer. By submitting a claim, you acknowledge and agree that your details may be shared with the alleged infringer.

Counter Notification – Restoration of Material

If you have received a takedown notice due to a copyright infringement claim, you can send us a counter notification to request the restoration of the material. The notification should be sent in writing to our DMCA Agent and must include the following elements according to 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material taken down and its original location.
  3. A statement, under penalty of perjury, that you believe the material was removed due to a mistake or misidentification.
  4. Your name, address, telephone number, and a statement accepting the jurisdiction of the federal district court for the judicial district where you live.

Repeat Infringer Policy

We have strict policies regarding copyright infringement. As per the Digital Millennium Copyright Act, we monitor and keep a record of DMCA notices and strive to identify repeat infringers. Accounts of those who violate our policies will be terminated.
